CalSTRS (Certificated & Certificated Administration):
As a certificated employee performing creditable service under the California State Teachers’ Retirement System (CalSTRS), you have the right to elect membership in the CalSTRS Defined Benefit Program at any time during your employment, in accordance with Education Code § 22455.5. This right applies whether you are employed full-time, part-time, or as a substitute. You are entitled to be notified of this option within 30 days of your initial hire or by March 1, 1995, whichever is later. If you choose to elect membership, that election must be made in writing and will remain in effect for the duration of your employment unless you terminate your service and withdraw your contributions. Please be aware that once you elect membership, it is irrevocable. If the district fails to notify you of your right to elect membership, it may be held responsible for retroactive contributions. We encourage all certificated employees to review their options carefully and contact Human Resources or CalSTRS for guidance regarding retirement membership.
- STRS/PERS Retirement Form (to be returned)
- CalSTRS Retirement System Election Form (to be returned only if you are NOT a member of STRS)
- Social Security Form SSA 1945 (to be returned)
***Please see the following information regarding retirement and substituting after retirement:
As a retired member of the California State Teachers’ Retirement System (CalSTRS), you may return to work in a CalSTRS-covered position without reinstating from retirement; however, your post-retirement employment is subject to specific limitations under Education Code § 22461. Each fiscal year, there is a statutory earnings limit that applies to compensation received for CalSTRS creditable service. If your earnings exceed this limit, CalSTRS is required to withhold the excess amount from your monthly retirement benefit. Additionally, you are subject to a mandatory 180-calendar-day separation-from-service requirement following your retirement date before performing any CalSTRS creditable service. Any compensation earned during this period may also be subject to benefit reductions unless an exemption applies. These provisions are in place to ensure compliance with CalSTRS rules and to protect the integrity of your retirement benefits. We recommend reviewing your options carefully and consulting with Human Resources or CalSTRS before accepting post-retirement employment.
